A.  Website term of use

This Website is owned and operated by Compare the Course ('we'/'us'/'our'), a limited company registered in England and Wales under company number: 07762733 having our registered office at 189 PICCADILLY, LONDON, W1J 9ES. We can be contacted by e-mail or by mail to the address set out above.

The website terms of use and our Privacy Policy as amended by us from time to time (“terms?) govern your use of our website, www.comparethecourse.com  and any and all services and when leaving comments about your experience as an student (reviews), details about your study interests (shortlists) that we make available on or through our website. By using our website, you are agreeing to these terms, whether you are just browsing (a “visitor?) or whether you are a registered user (a “member?). Please stop using our website if you do not agree to these terms.

We may revise these terms at any time at our sole discretion. If we do, we will notify you individually. Please also check back regularly for updates: you can easily determine whether changes have been made by confirming the version date at the top of these terms. Your continued use of our website means that you agree to these terms, as revised.

1.  Registration/ Password

1.1.   Although portions of our website may be visited by any visitor, you will need to register as a member if you wish to search, compare, enrol, add, update or promote and if you wish to contribute or use any of our community features, which includes dispatch of messages, creating a user profile, connecting to other users (institution/ agency/Student/ Businesses) and uploading images and videos. Registration on our website is free. 

1.2.   To register as a member, you must either:

Ø  confirm that you are over 16 years of age; or

Ø  if you are less than 16 years of age, please see Section 3, below.

1.3.   You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate, and up to date and complete. We reserve the right to terminate your membership and access to our website if we learn that you have provided false or misleading information.

1.4.   When you register to use our website, you will be asked to create a username and password. You agree not to divulge your password to any other person. You are responsible for maintaining the confidentiality of your password, and will be fully responsible for all liabilities arising in connection with your password's use (or misuse), whether such use or misuse is with or without your knowledge or approval. If you suspect that someone else knows of or is using your password, you must notify us immediately by emailing us.

1.5.   If you forget your password, we have an option to reset your forgotten password, if that does not work please send us an email.

1.6.   We have the absolute discretion to cancel your username/password at any time if we suspect it is being used by an unauthorised person.

2.  Your Use of our Website

2.1.   For the purposes of these terms, “content? refers to all data, text, logos, artwork, software, documents, images, photographs and other materials you may upload to or download from our website including information about yourself, and comments about your experience as an international student (review) or about your study abroad interests (profile/shortlist).

2.2.   You must ensure that any content that you submit to our website:

Ø  does not infringe any third party's intellectual property rights (“intellectual property rights? means registered and / or unregistered copyright, database rights, trade marks, design rights and other intellectual and proprietary rights of whatever nature, and all applications for such rights, anywhere in the world);

Ø  does not breach any applicable law;

Ø  is not defamatory, profane, sexually or racially offensive or discriminating, harassing, threatening, obscene, pornographic, false, unreliable or misleading or otherwise objectionable in our opinion; or

Ø  does not disrupt the online community on our website.

2.3.   You agree that you will not use our website:

Ø  for commercial purposes or to obtain financial gain without our prior written consent;

Ø  to send chain letters, junk mail, ‘spam’, business or bulk communications of any kind;

Ø  to advertise a company, product or service of any educational establishment except under the terms of a written advertiser agreement that we have entered into with you;

Ø  in a way, that might reasonably be expected to cause another person's computer systems and/or their communications network to be interrupted, damaged or rendered less efficient;

Ø  to obtain personal information from “users? (which means “members? and “visitors?) under the age of 16 or from anyone if such information is gathered deceptively or in a non-transparent way;

Ø  to obtain passwords or personal identifying information for commercial or unlawful purposes from other users;

Ø  to attempt to impersonate another user; or

Ø  to harass, threaten or intimidate any user.

2.4.   You will be for responsible for logging out from your registered account at the end of each session on our website.

2.5.   If you are a visitor, you agree not to obtain unauthorised access to areas of our website reserved for members.

2.6.   If you are aware of anything on our website which appears to infringe these terms, you agree to contact us immediately.

3.  Content Posted

3.1.   We make every effort to main our database and the content posted on our web portal and have a software tool which monitors content on our website. While we hope that it removes the majority of inappropriate content, it is not 100% reliable - no software tool is. None of the views expressed in the content are the views of Compare the Course or its team - we are just providing a platform. You acknowledge that all content is the responsibility of the person who posted, emailed or otherwise provided the content to our website. You acknowledge that by using the Service, you may be exposed to content that is offensive, indecent or objectionable. We are not responsible in any way for any content - and if you post, email, upload or otherwise provide content, you are entirely responsible for it.

3.2.   However, we operate a “take down and notice? procedure. If you believe that any content is defamatory, profane, sexually or racially offensive or discriminating, harassing, threatening, obscene, pornographic, false, unreliable or misleading or otherwise objectionable, or infringes intellectual property or other legal rights please notify us immediately by contacting our webmaster. We will investigate each matter notified to us and will act in our sole discretion.

3.3.   If you post content which is found to be in breach of these terms, we reserve the right to deactivate your username and password to prevent you from further access to our website as a member.

4.  Under 16 Years of Age

4.1.   If you are under 16 years of age and want to become a member, you must obtain a parent or guardian's permission before registering on our website. You may also discuss these terms with them before obtaining their permission.  

4.2.   If you are a member under 16 years old, you will need to obtain a parent or guardian's permission before taking part in any online discussions. You should never reveal personal information about yourself, such as your address, telephone number and school

5.  Intellectual Property rights

5.1.   Links to the website are not permitted, other than links to the homepage for your personal use, except with our prior written permission. Links to the website from within a frameset definition are not permitted except with our prior written permission.

5.2.   You may not remove any copyright, trademark or intellectual property notices contained in the original material from any material downloaded or copied from the website.

5.3.   Copying, distributing or any use of the material contained on the website for any commercial purpose is prohibited.

5.4.   We are the owner or licensee of all copyright and other intellectual property rights in any material contained on the website.

5.5.   You may access any part of the website and download or copy material (by printing off individual pages onto paper) or download material on to disk (but not on to any server or other device connected to a network) for personal non-commercial use only. The intellectual property rights in such material shall be retained by Compare the Course or, where the material has been licensed to Compare the Course, by the owners of the rights in the material.

5.6.   You agree that our website and all content contained in it are protected by Intellectual Property Rights that either belong to or are licensed to us.

5.7.   You acquire no proprietary interest in our website or content provided by us or others and may not use them in any way except as expressly permitted by these terms.

5.8.   By submitting content to our website:

Ø  you grant us a royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and communicate to the public such content; and

Ø  you authorise us to adapt such content and you agree to waive your moral rights to object to any derogatory treatment, or to be identified as the author, of the material in question.

5.9.   Any rights not expressly granted in these terms, or any document referenced in them, are reserved to Compare the Course.

5.10. The website contains trademarks which belong to Compare the Course or which have been licensed to Compare the Course by the trademark owners. Any use of these trademarks by you is forbidden unless prior written permission has been obtained from the trademark owner. Compare the Course will take legal action against any individual or organisation which seeks to use Compare the Course's name, material, logos or trademarks for unlawful purposes.

5.11.   You may not create a database by systematically downloading substantial parts of the website.

6.  Warranties

6.1. Our website is provided on an “as is? and “as available? basis. We expressly disclaim all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.

6.2. You understand and agree that we do not guarantee the accuracy, relevancy or completeness of any information in or provided on or from our website. We are not responsible for any errors or omissions or for the results obtained from the use of such information. Our website is provided for the general information of the general public.

6.3. Your use and participation in our website and services are solely at your own risk. No advice or information, whether oral or written, obtained by you from our website shall create any warranty not expressly made in these terms or imposed by law.

6.4. We make no warranty that our website will meet your requirements, or that access to our website will be uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of our website.

7.  Our Rights

7.1. We have the right in our absolute discretion to alter, edit, remove, suspend or refuse any content without notice, if we consider that the content is objectionable or violates these terms or for any other reason.

7.2. We may preserve or disclose the content and your personal details as well as any content to any third party if such disclosure is necessary:

Ø  for the purpose of maintaining our website;

Ø  by law; or

Ø  to respond to claims that our website infringes or restricts the right of any party.

7.3. We may suspend or terminate your access to our website at any time if you breach any of these terms.

8.  Limitation of Liability

8.1.             Except as required by law, we will not be liable for any direct losses or damages arising in contract, tort (including negligence) and for any reason.

8.2.             Except as required by law, we shall not be liable for any indirect, incidental, special or consequential losses or damages or loss of profits, data, goodwill, revenue in each case regardless of whether such losses or damages arise in the normal course of events or whether we have been advised of the possibility of such damages and whether such losses or damages arise in contact or tort (including negligence) and for any reason.

8.3.             Nothing in these terms shall operate to exclude or restrict our liability for death or personal injury caused by negligence.

9.  Territory Statement

Please do not access or use the content from a jurisdiction where such access or use would be contrary to applicable laws, rules or regulations of any governmental authority or regulatory organisation. If you breach this provision, you will be held entirely responsible.

10.     Assignment

We may assign our rights and obligations under these terms and upon such assignment we shall be relieved of any further obligation under these terms. You are not permitted to assign your rights and obligations under these terms.

11.     Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of England any dispute shall be subject to the non-exclusive jurisdiction of the English courts.

12.     Disclaimer

12.1. Compare the Course has taken care to ensure that the information on the website is correct. However, no warranty, express or implied, is given as to its accuracy and Compare the Course does not accept any liability for error or omission. Compare the Course is not responsible for how the information is used, how it is interpreted or what reliance is placed on it. We do not guarantee that the information on the website is fit for any particular purpose. You should also be aware that the availability of courses of study is subject to conditions applied by individual institutions at their sole discretion.

12.2. The content of the website is for general information only and does not constitute any form of advice or recommendation upon which a specific decision should be made. Compare the Course has taken steps to ensure the materials contained on its website are current and accurate, but to the fullest extent permitted by law Compare the Course hereby excludes any warranty, whether express or implied, by statute at common law or otherwise, relating to the website and the material contained on the website. In particular (but without limitation of the above), COMPARE THE COURSE gives no warranties as to quality, accuracy, timeliness, completeness or fitness for a particular purpose of the website or of the material contained in it.

12.3. To the fullest extent permitted by law, COMPARE THE COURSE shall not be liable for any claims, costs, penalties, loss (whether direct, indirect or consequential and whether economic or special loss of any nature), damages or expenses arising from the use or from the inability to use the website. COMPARE THE COURSE does not accept liability from reliance on information or advice contained on the website or from any unauthorised access or alteration to the website by a third party.

12.4.Nothing in these terms and conditions shall exclude liability for death or personal injury directly caused by the negligence of COMPARE THE COURSE, nor any other liability which cannot be excluded or limited under applicable law.

12.5. The website includes links to external websites. These links are provided to help you find additional information quickly and easily. COMPARE THE COURSE accepts no responsibility for the content of these websites and specifically excludes (to the fullest extent permitted by law) all liability that may arise with respect to or as a result of such material causing damage, costs, injury or financial loss of any kind. COMPARE THE COURSE cannot be responsible for the protection and privacy of any information that you provide whilst visiting these websites.

12.6. Whilst the website may from time to time contain advertising material, COMPARE THE COURSE does not endorse or accept any liability for any of the products or services so advertised, or for any error or inaccuracy in the advertisements. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the website complies with all relevant laws.

13. General

13.1. These terms are not intended to confer any benefit on a third party under the provision of the Contracts (Rights of Third Parties) Act 1999.

13.2. These terms shall be construed and interpreted in accordance with English law. The courts of England shall (except as set out in clause 13.3 below) have exclusive jurisdiction in relation to any claim, dispute or other matters arising there from.

13.3. For the exclusive benefit of Compare the Course, we reserve the right to bring proceedings in the Courts of the country of residence of any user of the website.

13.4. If any provision of these terms and conditions is found to be invalid by any Court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions which shall continue to have full force and effect.

13.5. The failure by us to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.

14. Terms and conditions for Applying using apply now  

14.1. These terms & conditions confirm your agreement to the general terms and conditions of the use of COMPARE THE COURSE website, the privacy policy and for use of Apply now (the “Product").

Ø  By using this Product you acknowledge that you accept all terms and conditions of this agreement (“Agreement?), which include:

Ø  Those contained in this website's general terms and conditions for its use.

Ø  Those contained in the declaration in respect of your application.

Ø  Those contained in the privacy policy and data protection statement in the declaration.

Ø  The terms and conditions for use of the Product as set out below.

14.2. Licence to use the Product

14.2.1. In consideration of you agreeing to abide by the terms of this Agreement, you are hereby granted a non-exclusive, non-transferable licence to use a single copy of the Product on your own personal computer in connection with your application to one or more higher education institutions (your “Application?).

14.2.2. You may copy material (by printing off individual pages on to paper) for your personal Non-commercial use only.

14.2.3. You must not: -

Ø  translate, disassemble, decompile,  modify or reverse engineer the Product in whole or in part or merge it with other software programs.

Ø  adapt any modules of the Product for your own purposes.

Ø  use the Product for any commercial purpose whatsoever.

14.2.4. You must not at any time publish or disclose to any unauthorised person any confidential information relating to the Product, or any passwords or user names  provided to you by COMPARE THE COURSE to enable the use of the Product or the website.

14.3. Licence to use materials provided by you as part of your Application

14.3.1. You hereby grant to us a licence (including the right to sub-license) to use all data, text, information, or other materials which you provide to us in connection with your use of the Product and your Application (“Application Data?) to:

14.3.1.1. process, store and electronically reproduce the Application Data and display the Application Data on the Product.

14.3.1.2. reproduce and distribute through any media now known, or hereafter

developed, excerpts of the Application Data to higher education institutions chosen by you as part of your Application, and any other agreed third parties. 

14.4. Reliance on information

14.4.1. The institution and course data contained in the Product reflects the most current information known to COMPARE THE COURSE. Institutions may add or cancel courses after this date. You should check each time you use the Product to see if there have been any changes made which may affect your Application.

14.4.2. University and course codes and other information contained in the Product are supplied to enable completion of your Application only and do not constitute any form of advice or recommendation relating to any particular course or institution.

14.5.  Termination

COMPARE THE COURSE shall have the right to terminate your use of the Product immediately if you fail to comply with the terms and conditions of this Agreement.

B.   Terms and Conditions for Funding Providers and Advertisers

Welcome to the Terms and Conditions for Compare the Course Ltd.

The services provided at http://www.comparethecourse.com are provided by Compare the Course Ltd.

Compare the Course Ltd is registered in England and Wales, Company No 07762733 Registered Office Address:  189 PICCADILLY, LONDON, W1J 9ES. The terms and conditions set out below apply to your use of our services at comparethecourse.com. If you do not agree to be bound by these Terms and Conditions, you may not use our services. You must read, agree with and accept all these Terms and Conditions, and our Privacy Policy, and our Payment Terms and Conditions on our Prices pages, which form part of these Terms and Conditions, before using any of our services.

ComparetheCourse.com accepts studentship postings through the purchase of advertising 'slots', and other advertising from both Funding Providers and other advertisers. Comparethecourse.com accepts course listings through free or paid for listings from Universities, Colleges, Training providers and other advertisers.

'Universities' and other 'Funding Providers' refers to all advertisers on  comparethecourse.com that have specific or general  course programme funding or study opportunities that can be advertised on the sites.

The public area of comparethecourse.com refers to the area of the sites that are visible to all users of the sites.

15.   Publication of Advertisements

All advertisements, including all studentships and course listings will only be published on the public area of the sites when the funding provider has been fully approved by Compare the Course Ltd or by the registered organisational Administrator for the Provider's or Advertiser's organisation, if the organisation is already registered and approved on comparethecourse.com.

All advertisements, including all studentships and course listings will be published on the public area of either or both sites for the duration of the advertisement agreed when the advertisement is booked, which will be a maximum of 1 year. After this date they will be removed from the Public area of the site. The publication date is deemed to be the date the advertisement is first published on either site, even if the advertisement is subsequently withdrawn for editing purposes and republished at a later date.

All advertisement slots and course listings bought on comparethecourse.com are available for immediate use and remain valid for use for 6 months from the purchase date. Slots remaining unused after 6 months will be deleted from the purchasers account unless otherwise agreed with Compare the Course Ltd at least 1 month before the full 6 months has elapsed. No refunds are given at any time for slots purchased as part of any advertising package which are not subsequently used by the Provider before they expire. Providers will be notified one month before any remaining slots are due to expire.

Providers may edit and resave published advertisements but may not make changes such that a different advert for a different funding or study opportunity is deemed to have been created, in the opinion of Compare the Course Ltd. It is the responsibility of the Funding Provider to purchase new advertisement slots in these circumstances and/or to clarify with Compare the Course Ltd whether a new advertisement slot is required, before editing takes place. Compare the Course Ltd reserves the right to invoice Providers for any new advertisements that have been created in this way, and/or to suspend the advertisement in question on comparethecourse.com website.

16.   Payment

All comparethecourse.com invoices issued Compare the Course Ltd are payable within 30 days of the invoice date unless otherwise agreed in writing with comparethecourse.com team at the time when the advertisement is booked:

Ø  The invoice date is the date of purchase of an advertisement package, and NOT the date when the advertisement is first published on the public side of the site.

Ø  Please note however that advertisement packages are not deemed to be purchased until the Advertiser or Funding Provider is fully approved on comparethecourse.com.

If payment is not received by the due date, Compare the Course Ltd reserves the right to remove the advertisement(s) in question from the public side of the sites and to suspend the account, and if necessary all accounts registered with Compare the Course Ltd attached to the organisation in question, so that no new advertisements or postings of any kind can be made until such time as payment is received Compare the Course Ltd.

Compare the Course Ltd reserves the right to require payment in advance from Providers and other Advertisers before any advertisement is published.

17.   Information Provided by Education Providers and Advertisers

All information given by advertisers on any part of the sites, including advert content, must be accurate and up to date. It is the advertiser's responsibility to ensure that content is not misleading, inaccurate, and does not make false claims, or claims that could be construed as false or misleading about their own or any other organisation, or students that have attended their organisation. Compare the Course Ltd does not accept liability for any actions taken or not taken by any site user as a result of Advertiser or Funding Provider information being incorrect on the sites.

Compare the Course Ltd reserves the right to withdraw without notice, advertisements of any type, or written contributions to any part of the public side of the sites, by Funding Providers and other Advertisers, should any of the advertisements or contributions contravene any of the terms and conditions in this document, or should they be, in the opinion of Compare the Course Ltd, inappropriate or offensive in such a way as to be likely to bring Compare the Course Ltd, or comparethecourse.com into disrepute. In such circumstances, no refunds will be given.

18.   Compare the Course Ltd Services

We do not guarantee continuous, uninterrupted or secure access to our services, and by using our websites, you accept that we do not. We do not accept liability for any loss or damage to persons or property caused by the interruption of any part or all of our services.

Compare the Course Ltd does not and cannot check or confirm the claimed identify of users or the accuracy or honesty of the information provided by users on our websites. We do not control the information posted by other users, including students seeking funding, on our sites, or that they make available to you as a result of using our websites. We cannot guarantee its accuracy, content, character or tone.

19.   Your general activities on our websites

Your activities' includes any and every posting you make on comparethecourse.com, whether directly related to an advertisement or other listing, or not. It also includes all information you may provide to us, or to any third party, including other users or the sites, that is in any way related to activity in which you engage on our websites. It also includes any activity you may engage in in any way related to your use of our websites.

Your activities on our websites must not:

Ø  Be false, inaccurate, misleading, dishonest or fraudulent

Ø  Be offensive, menacing, abusive, defamatory, obscene or indecent, or in breach of copyright, confidence, privacy or any other rights

Ø  Infringe any third party's copyright, patent, trademark or any other legal rights

Ø  Be in breach of any applicable laws

Ø  Create liability for us or cause us to lose (in whole or part) the services of our ISP or any other suppliers.

Ø  Link directly or indirectly to, or otherwise promote, mention, include or imply, descriptions of goods or services that are prohibited under these Terms and Conditions, or that you do not have a right to link to or include.

Ø  Contain or include in any way any computer-borne, -driven or related elements of any sort designed to disrupt the normal operations of any computer or website, or designed to remove, copy, or otherwise gain unauthorised access to the information contained on our website or on the computers of any other comparethecourse.com user.

Ø  Cause any disruption of any sort to the normal functioning of our websites, or any risk of disruption at any point in the future.

You allow Compare the Course Ltd the perpetual, non-exclusive right to use or quote from any of the information or postings you provide us with through the use of our services, either elsewhere on our websites or outside our websites for any reasonable purpose including but not limited to, publicity and promotion, or defence in a court of law, other than as restricted under our Privacy Policy in any media known or currently unknown.

20. Indemnity

You agree to indemnify and hold us and (as applicable) our subsidiaries, affiliates, officers, directors, agents and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.

21. Notices

Unless otherwise explicitly stated, notices to Compare the Course Ltd must be sent by registered mail to Compare the Course Ltd.

Notices to you will be sent to the email address you provide us with during the registration process (receipt is deemed 24 hours after an email is sent, unless notice is received that the email address is invalid), or by registered mail.

C. Cookies

When we provide services, we want to make them easy, useful and reliable. Where services are delivered on the internet, this sometimes involves placing small amounts of information on your device, for example, computer or mobile phone. These include small files known as cookies. They cannot be used to identify you personally.

These pieces of information are used to improve services for you through, for example:

Ø   enabling compare the course to recognise your device so you don't have to give the same information several times during one task and presenting you with the most relevant courses, programs, reviews and scholarships.

Ø   recognising that you may already have given a username and password so you don't need to do it for every web page requested, for example when enquiring to universities and colleges

Ø   measuring how many people are using our sites, so they can be made easier to use and there's enough capacity to ensure they are fast

Ø   You can manage these small files yourself and learn more about them through Internet browser cookies - what they are and how to manage them.
